TERMS OF SERVICE

1. DESCRIPTION OF SERVICE

Salesbooster provides a multi-tenant, cloud-based Software-as-a-Service (SaaS) platform designed to automate sales, customer support, and product inquiries. Our services include:

• Automated conversational AI agents for Facebook Messenger and WhatsApp Business Cloud API.
• Real-time product catalog embedding, searching, and recommendation engine (RAG System).
• WooCommerce inventory synchronization and order management.
• Manual payment top-ups, transaction logging, and usage credit management.

2. REGISTRATION, ACCOUNT SECURITY & ELIGIBILITY

To use our services, you must register for an account by providing accurate and complete information, including your full name, email address, phone number, and password.

• You must be at least 18 years of age or the legal age of majority in your jurisdiction to create an account.
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized access, security breach, or compromise of your account credentials.

3. META PLATFORMS COMPLIANCE & API POLICIES

Salesbooster integrates with Meta Platforms, Inc. APIs (specifically Facebook Messenger and WhatsApp Business Cloud API). To use these integrations, you agree that:

• You will comply with all of Meta’s Developer Policies, Platform Terms, and Business Policies, including the WhatsApp Business Policy and Messenger Platform Policy.
• You will not use our platform to send unsolicited spam, mass unsolicited marketing messages, or violate the messaging guidelines enforced by Meta.
• Any restriction, suspension, or termination of your Meta accounts, Facebook Pages, or WhatsApp numbers by Meta is beyond our control and we are not liable for any service interruptions caused by such events.
• You are solely responsible for obtaining the necessary consents from your customers to contact them via WhatsApp or Messenger.

4. SUBSCRIPTION, PAY-AS-YOU-GO WALLET & CREDITS

We operate a flexible pay-as-you-go credit ledger system to charge for AI execution and API routing fees:

• Prepaid Wallet Top-up: Users top up their wallet balances manually using local payment methods (such as bKash, Nagad, or Rocket). All submitted transaction IDs must be valid. Fraudulent submissions will result in immediate workspace suspension.
• Credit Consumption: Every automated AI reply consumes system credits based on the active model’s cost (e.g., 1 credit for standard text, 5 credits for image analysis). If you bring your own custom AI keys, a flat system routing fee of BDT 0.05 per message is deducted directly from your wallet balance.
• Insufficient Balance: If your credits or wallet balances are depleted, the AI automation will be paused immediately and switched to a manual takeover state. You must top up to resume automation.
• Refunds: All wallet top-ups and purchased credits are non-refundable unless required by local consumer protection laws.

5. ACCEPTABLE USE & PROHIBITED CONDUCT

You agree not to use, or permit your AI agents to be used, for any unlawful, harmful, or fraudulent activities. Prohibited conduct includes, but is not limited to:

• Generating or distributing hate speech, harassment, sexually explicit content, or promoting violence.
• Tricking customers or executing scams through automated chat agents.
• Attempting to hack, reverse-engineer, or compromise the integrity and security of the Salesbooster infrastructure, database, or APIs.
• Using unauthorized scripts or bots to extract data from our platform.

6. INTELLECTUAL PROPERTY RIGHTS

All rights, title, and interest in and to our platform, including software, design patterns, logos, system instructions, and database architectures, belong exclusively to Salesbooster.

You retain all ownership rights to the product catalogs, images, and customer databases you upload to your workspace. By uploading this content, you grant Salesbooster a worldwide, non-exclusive, royalty-free license to use, process, and display your data solely to provide and maintain the automated services for your workspace.

7. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

Our services are provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the continuous availability, error-free operation, or absolute accuracy of responses generated by our AI models. Under no circumstances shall Salesbooster be liable for any indirect, incidental, special, or consequential damages (including loss of profits, revenue, or customer data) arising out of or in connection with your use of our platform or connected Meta APIs.

8. TERMINATION & SUSPENSION

We reserve the right to suspend or terminate your account and workspace access immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activities (such as fake mobile transaction entries), or violated Meta’s Developer Policies. Upon termination, your right to use our services ceases immediately, and we may delete all data stored under your workspace.
